Description
Inquisition made at Perth on 17 September 1304, in the presence of Sir John, earl of Atholl, warden and justiciar of Scotland from Forth to Orkney, as to the pleas depending between the earl of Strathearn and Sir John de Mowbray, by Sirs Gilbert de Haya, David of Wemyss, William of Clunie, John de Haya, Walter de Ackinhevy, and Mark of Clapham, knights, Adam de Hallens, David de Muschet, John of Balfour, Herbert of Kinross, Andrew Franckysman, John de Lany, Richard of Fody, Gilbert the clerk, Malcolm of Gatemilk, Patrick of Glendhouchret, Gilchrist de Boffodyr, Brice the clerk, Gilchrist son of Donald, jurors; who say that Sir John de Mowbray sued Sir Malise earl of Strathearn before Sir John Comyn, guardian of Scotland, for ravaging his lands of Methven and taking the castle, because his father Sir Geoffrey had withdrawn from the king’s peace in the beginning of the war, and Sir John so conducted his case that for fear of greater damage the earl made a fine with him. They know of no other contract between them. They append their seals, place and date aforesaid.
