Description
Robert, bishop of Glasgow, addresses the vicars of Carmunnock, Cathcart, Pollock, Kilmacolm and Kilbarchan, and states that he is mindful of his mandate against Sir Malcolm, earl of Lennox, his vicegerents, Walter Sproull, his steward and others holding suit of court, who took action against the abbot and convent of Paisley, in relation to the land, alms and possessions conveyed to the church of [Old] Kilpatrick (DNB) by the donation of various earls of Lennox, and granted and obtained in pure and perpetual alms, as the bishop saw to be fully contained in the charters concerning these grants, and he states that this should be public and known in the earldom of Lennox where the aforesaid lands are situated [which] was being held back in his lay-court. Moreover, [the bishop is mindful of his mandate] against Robert Reddehow and Johanna, his wife, who in the prosecution of their cause against the monks concerning the same alms-lands in the court of the earl should thoroughly stop and cease [their actions], under the penalty of major excommunication by the bishop, if they should proceed to blindly go against the tenor of his mandate. Concerning which, the earl, Walter Sproull, his baillie, and others holding suit against the bishop’s mandate and prohibition, and also against the warning legitimately made to them, proceeded in the causes and complaints concerning the alms-lands, against God and justice, and they proceed to seize to portions of the two commodities of the goods of the monks, and unjustly detain the seizures, against the liberties of the church, for which the monks wished to respond for in their lay-court concerning the alms-lands. And also, Robert and Johanna his wife were to pursue the aforesaid, against the bishop’s mandate, in the said court, and from that day in which they did not fear to pursue [the aforesaid] unjustly, as by the bishop’s certification concerning this action clearly stipulated, sentence of great excommunication is to be incurred, and also is to be sustained. The bishop firmly mandates the vicars not to go against his action and to take seven or six of their order to the court of the earl or his vicegerents, or to whatever other lay form, concerning the aforesaid alms-lands, viz. of Cochno (DNB), Edinbarnet (DNB), Faifley (DNB), Backan (DNB), and Drumcrewe (DNB), given to the monks by reason of the church of [Old] Kilpatrick (DNB), in pure and perpetual alms. Additionally, the vicars should repeatedly and legitimately advise Robert and Johanna, his wife, and whoever else goes against the monks concerning the alms-lands that they should cease everything in prosecution of the cause, since the bishop was, is and will be prepared to make complement for the monks and their alms-lands, and the bishop states that he will excommunicate other malefactors. Additionally, the vicars should remind Patrick of Graham, Duncan son of Amlaib (Aulay), Donald Campbell, William Olifard, the knights, Arthur called Galbraith, Malcolm of Drummond, Thomas of Craminnan, John of Luss, Humphrey of Kilmun, Alwin son of Sir Amlaib2 (Aulay) Morthan Mac Korc (prob. from Corc, brother of Earl Maldoven) , Maelmuire (Malmure) Hoge, Maurice (Murdoch?) of Ardencaple, John Napier, Eugene son of Michael Gross, Maldoven MacHudy, Donald MacAnecol, Beherum brother of the same Donald, Gilchrist MacMolbrid (= mac Maelbride), Ewen son of Duncan (Eogan son of Donnchad), Roger de Muhaut (Mowat), John MacGilmothan, Dunbeger’, Gilismum (Gilise/ Gille Isu) MacNalbain, Gilismum (Gilise/Gille Isu) Ruphum (Ruffus?), Thomas of Kintyre, and Gillecolm son of Donald Macbref that they should not presume to have any interaction with the excommunicated or their men, and additionally, all the rectors, vicars, parish priests of the deanery of Lennox, and additionally the archdeacon of Glasgow, should not presume to celebrate divine office in the churches and chapels in which the excommunicated are present, or do other things, under penalty of excommunication.
