Description
An agreement is formed between Abbot Robert and the convent of Kelso and Roger Lauird of Berwick, Eda, his wife and Hugh, his son and heir, whereby the abbot and convent of Kelso shall receive yearly 20s. from the rents of the lands of Roger in ‘Waldefgat’ in the villa of Berwick for up to 12 years for the sum of money that the abbey paid to Roger, Eda and Hugh in their great need, beginning Christmas 1257. If it happens that, through war or by powerful violence of another, Roger, Eda and Hugh are hindered, they shall hold the said rent in their hands until they have recovered from all injury and loss. Roger, Eda, his wife and spouse, and Hugh, have bound themselves to provide an oath, so that this shall be protected, and faithfully held and warranted, free from all burden, exaction, payment and demand, and everything of the burgh – whether the burgh of Berwick or another - suits and all trouble which might come about by reason of the debt or of another royal subsidy, or whatever obligations regarding the dowry, marriage or terce of Eda. Similarly, should the abbey and convent be liable for any damage or impediment from the rent of 20s., they promise to guard the abbey against injury. Similarly, they bound themselves to guard the above-written faithfully, subjecting themselves to the jurisdiction of the abbot and convent of Kelso that by their authority they may excommunicate Roger, Eda and Hugh, in their chapter of Kelso, without appeal of justice. Roger and Hugh have granted that if at any time they attempt to go against this agreement, all their tenement in and outwith Berwick will be granted to the abbot in pure and perpetual alms.
