Description
An agreement is formed between Dryburgh Abbey and Melrose Abbey concerning the teinds of the church of Lessudden (ROX) whereby – saving to Dryburgh Abbey the garbal teinds and teinds of hay that they, before this agreement, secured of the lands which the porter of Melrose held in the territory of Ylistoun, within the parish of Lessudden on the day of this agreement – the abbot and convent of Melrose shall pay through their porter to Dryburgh Abbey 1 mark at the fair of Roxburgh for all indemnities of the lands. The abbot and convent of Melrose shall hold the lands, and the servants of the same abbot – who shall do their service within the parish each year or half year – shall pay in full to the mother church of Lessudden all ecclesiastical rights. If it happens that any others shall hold the land, they shall pay to the mother church of Lessudden all ecclesiastical rights of the same and the said abbot of Melrose shall be free from the payment of one mark, saving all prescribed articles, together with the said land, which shall be released to Melrose. And if it happens that the abbot of Melrose holds in whatever way other lands in the parish of the abbot of Dryburgh, or acquires by the time of this agreement or if the abbot and convent Dryburgh holds or acquires other lands in the parish of the abbot and convent of Melrose, each church shall be safe from injury through the counsel of the abbot of Rievaulx and Alnwick, who shall chose a third party, belonging to neither part, under whose jurisdiction and power each side placed himself, so that the abbots shall be able to coerce each side to observe this on pain of ecclesiastical censure.
