Description
Thomas, abbot of Lindores and the prior of the same place, papal judges-delegate, recite letters of Pope Alexander [IV] appointing them judges in the case between the abbot and monks of Reading concerning goods of the priory of May, St Andrews diocese. The judges, by the authority of the mandate, settle the complaint between the abbot and convent of Reading, plaintiff, and Adam, son of Adam, son of Philip, burgess of South Berwick, defendant, concerning a certain tenement in the villa of South Berwick in the street of Briggegate between the tenement of Walter of Lindsay and the tenement of Arnold le Windrawere, which certain tenement with pertinents and fruits, they estimate at 500 marks. The abbot and convent had claimed that they and their church be recalled and adjudged, as [they had been] alienated wrongly and illicitly occupied by the said Adam. After many altercations and expenses, on Monday after the feast of St Luke the evangelist, 1261, in the conventual church of St Andrews, the case was settled thus; the abbot and convent, through their procurator, renounced any action which they have or could have at any other time against Adam concerning the said tenement, saving 2 marks annually to the brothers of May from the tenement in the villa of Berwick, that is, one at Martinmas and the other at Pentecost. If Adam or his heirs falter from the payment, the prior of May is permitted, in the name of the abbot and convent of Reading, to enter into the said tenement without any contradiction or impediment and [take] from all the goods in that place until they are satisfied in full for the expenses of 2 marks. The abbot and convent may not resuscitate a lawsuit against Adam concerning that tenement; they renounced the reinstatement of all letters obtained or to be obtained, everything which can be presented against what was made, and all civil and canonical remedy of justice.
