Description
Richard, bishop of St Andrews and J[ocelin], bishop of Glasgow, as papal judges-delegate, hear and decide the dispute between Kelso Abbey and Lambert over land in Berwick which had belonged to Dodin and which Lambert said ought to belong to him by hereditary right. The parties were summoned twice. The abbot produced sufficient and suitable witnesses who affirmed on oath to have seen and heard, whereas Lambert was deficient in proof, and so the abbot was absolved by the judges. At length, though with difficulty, moved by the judges’ pleas, the abbot and monks gave Lambert the land in Roxburgh which Gilbert del Halach gave to them and twenty shillings to construct a building. However, because there was a woman on that land who could not be moved, she would pay Lambert the two shillings annually which she was accustomed to pay to the abbot. The abbot would give him half a mark from his chamber until the land became free. After Lambert got the land he would have nothing from the abbot’s chamber, but would pay the abbot and monks 12d. annually, and defend it against the king in all things. Lambert did homage to them for the land and swore fealty and quitclaimed to the abbot and monks whatever right he had in that land in Berwick that had belonged to Dodin or his father or mother. He gave up, both for himself and for his heirs, all claim against the abbot and church of Kelso to that land or any other, pledging his faith in the hands of the abbot and Master Andrew, archdeacon of Lothian, that he and his heirs would observe this in good faith.
