Description
Pope Innocent IV takes the priory of the cathedral church of St Andrews into his protection; all the possessions and goods which the abbot and brethren possess canonically and other privileges and goods which they have or may acquire by papal permission, by the liberality of kings or the gifts of the faithful shall remain with them, including the place where the church is situated, the abbey of the island of Loch Leven with lands and all pertinents, the hospital of St Andrews, with lands, possessions, all rents, and pertinents, the church of Linlithgow (WLO) with the lands, houses, chapels, teinds and the school there, the church of Longforgan (PER) with a toft, lands and pertinents, the church of Haddington (ELO) with chapels and pertinents, the right of patronage which they have in the churches of Dairsie (FIF), Cupar (FIF), Markinch (PER), Scoonie (FIF), Portmoak (KNR), St Cyrus (KCD), Lathrisk (FIF), Kennoway (FIF), the church of Holy Trinity (in St Andrews, FIF) with chapels and pertinents, the churches of ‘Egglesrilue’ (KCD) , Leuchars (FIF) and Inchture (PER), with chapels, the churches of Fowlis Easter (ANG), Tarland (ABD), Migvie (ABD), Muckersie (PER) with pertinents, the church of Meigle (PER) with the chapel, ecclesiastical villa, the church of Tannadyce (ANG), the Pentecostal procession of Lothian and Scotia, as R[ichard], late bishop granted, the land between the town and church, as the river Kinness flows into the sea, the grange of Balone (FIF) with pertinents, the grange of Strathkinness (FIF) with pertinents, the granges of Drumcarro (FIF) and Naughton (FIF), the mill of the whole parish of the city of St Andrews, the church of Rossie (ANG) with lands and mills, from the gift of Hugh Giffard, 20s. annually, from the gift of Alan, son of Walter, one toft in Rutherglen (LAN) and half a ploughgate of land at Dundonald (AYR), from the gift of Walter, son of Alan, 10s. yearly, from the gift of Henry Lovel, 2 oxgangs of land in the territory of Hawick (ROX), from the gift of Merleswain, the land called Kilmux (FIF), next to Kennoway (FIF) and all the land which they have in the burghs of Berwick, Roxburgh, Edinburgh, Stirling and Perth, the churches of Dull (PER) and Bourtie (ABD), with all pertinents, liberties and immunities. Everyone is debarred from presuming to exact teinds from the priory, in respect of fallow lands which they cultivate with their own hands or at their own expenses, or of food for their animals. They are permitted to take in whatever clerics or laymen have fled from the secular world and have converted freely, and to retain them without any contradiction. None of the brothers, after making their profession, shall be permitted to depart without the permission of the prior; no one may intend to depart without the surety of common letters; they are permitted the right to celebrate divine office privately and quietly during a general interdict. No one is permitted to construct oratories or chapels within the boundaries of the parishes of the churches, without the assent of the bishop and prior, saving the privileges of the papacy. No archbishop, bishop, archdeacon or dean shall impose new exactions or customs of the churches or chapels which are not owed. Burial, for those who shall decide to be buried in that place, will be unimpeded, except for those excommunicated or under interdict, saving justice to the church where they are buried. Teinds and possessions belonging to the church by right which are detained by laymen are to be returned to the priory. On the death of the prior, or his successors, no one may be advanced to that office by deceit or violence, unless the brothers by common consent, or a majority of them, shall provide that the prior be elected in accordance with the Augustinian rule. Within their enclosed places or granges, no one may commit arson or theft, robbery, seize or murder men, or committing other violence. He establishes all the liberties and immunities granted by his predecessors and those liberties and exemptions of secular exaction granted by kings, by princes or other faithful. The pope directs that no man is permitted to disturb the church or carry away its possessions; saving to the bishop canonical justice and reverence and the authority of the apostolic see. Should any secular person attempt to go against this, after three warnings if he should not make amends, he may lost his honour and be liable to divine justice, and subject himself to retribution.
